Terms of Use

1. Description of Service

AutoFrame: Collage Maker is a mobile photo collage application that uses on-device image analysis (Apple Vision Framework) to detect human subjects in your photos and automatically align them into professional-looking collages. The App is offered as a freemium service, with certain features available only through a paid subscription ("Pro").

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

The App does not require you to create an account or provide login credentials. Your subscription status is managed through your Apple ID account and processed by our subscription management partner, RevenueCat.

4. Subscriptions and Payments

4.1 Free and Pro Tiers

The App offers a free tier with basic functionality and a Pro tier with additional features. Free-tier collages may include a watermark that is removed for Pro subscribers.

4.2 Billing

Pro subscriptions are billed through the Apple App Store ("Platform"). By purchasing a subscription, you agree to the pricing and payment terms presented to you at the time of purchase. All payments are processed by the Platform, not by us directly.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Platform account settings.

4.4 Refunds

Refund requests are handled by the Platform in accordance with their refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple App Store Support.

4.5 Price Changes

We may change subscription pricing at any time. Any price change will take effect at the start of your next billing period following notice of the change. Your continued use of the Pro tier after a price change constitutes acceptance of the new price.

4.6 Restore Purchases

If you change devices or reinstall the App, you may restore your previously purchased Pro subscription by using the "Restore Purchase" feature within the App settings. To successfully restore a purchase, you must be logged into the same Apple ID account used for the original transaction. We do not maintain a separate user account database for these subscriptions; all entitlement logic is managed via our partner, RevenueCat, in coordination with the respective Platform.

5. Your Content

5.1 Ownership

You retain full ownership of all photos, images, and collages you create using the App ("Your Content"). We do not claim any ownership rights over Your Content.

5.2 On-Device Processing

All image analysis, subject detection, and collage creation is performed locally on your device. Your photos are not uploaded to our servers. Please refer to our Privacy Policy for more details.

5.3 Responsibility

You are solely responsible for Your Content and for ensuring you have the right to use any photos you import into the App. You agree not to use the App to create content that is unlawful, defamatory, obscene, or that infringes on the rights of any third party.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, or create derivative works based on the App.
• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
• Use the App in any manner that could damage, disable, overburden, or impair its functionality.
• Distribute, license, sell, or otherwise transfer the App or access to it to any third party, except as expressly permitted by these Terms.

7. Intellectual Property

The App, including its design, features, code, graphics, icons, and all related intellectual property, is owned by BiBi Builds LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, BIBI BUILDS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. We make no guarantees regarding the accuracy or reliability of subject detection or image alignment results.

9.1 Image Processing Accuracy

The App utilizes the Apple Vision Framework to perform on-device subject detection and alignment. You acknowledge that the quality, accuracy, and "professional" appearance of the resulting collages are highly dependent on the quality of the original photos provided by you. Factors including, but not limited to, low lighting, motion blur, low resolution, or complex backgrounds may significantly impact the App's ability to detect subjects correctly. We make no guarantee that the App will accurately identify subjects in every photo.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIBI BUILDS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless BiBi Builds LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your license to use the App will immediately cease. Sections 5.1, 7, 9, 10, 11, and 14 shall survive any termination of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Wyoming.

15. Apple App Store Additional Terms

Acknowledgement: You acknowledge that these Terms are concluded between you and BiBi Builds LLC only, and not with Apple, Inc. ("Apple"). BiBi Builds LLC, not Apple, is solely responsible for the App and the content thereof.

Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.

Maintenance and Support: BiBi Builds LLC is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BiBi Builds LLC regarding your use of the App and supersede all prior agreements and understandings.
